This End User Licence Agreement ("Agreement") is between you and Adam Sturrock, the independent developer who makes and operates Shards of Stone ("we", "us", "our"). It covers the Shards of Stone game software in every form we provide it: in a web browser, as the downloadable desktop app, and embedded on other sites (together, "the Game").
You accept this Agreement by selecting "I agree" when the Game asks, or by installing or playing the Game. If you do not agree, do not install or play it.
Accounts, multiplayer, the forum and the other online services are also covered by the Terms of Service, and how we handle data is set out in the Privacy Policy. If this Agreement and the Terms of Service disagree about the licence to the Game software, this Agreement applies.
The Game is licensed to you, not sold. As long as you follow this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable licence to play the Game in your browser and to install and run the desktop app on devices you own or control, for your own non-commercial enjoyment. The Game is free to play, and this licence costs nothing.
You may record, stream and share videos and screenshots of the Game, including where you earn money from the channel they appear on, provided you do not present the Game as your own work.
Except where this Agreement, our modding documentation or the law allows it, you may not:
The cheat codes and the AI commander that are built into the Game are part of it, and using them where the Game offers them is not a breach of this Agreement.
The Game includes a map editor and supports mods. You may use them to create maps and mods and to share them through the Game, in the formats and within the limits described in our documentation. What you create with them is yours. The licence you give us to host and distribute it, and the rules for what it may contain, are in section 8 of the Terms of Service and in the Community Rules.
Maps and mods made by other players are their work, not ours. We do not review every one, and you play them at your own risk.
The Game, including its code, art, models, animation, sound, music, voice, text, names and logos, is owned by us or licensed to us, and is protected by copyright and other laws. This Agreement gives you a licence to use the Game and nothing more. All rights not expressly granted to you are reserved.
The Game includes open-source software and fonts that remain under their own licences. They are listed on the Credits and Licences page, and nothing in this Agreement limits the rights those licences give you over that software.
The desktop app may download updates and game files automatically so that it keeps working. We may change, add or remove features, units, maps and balance at any time, and an update may be required to keep playing. Some features need an internet connection, and some need an account. We may suspend or end any online feature, or the Game itself, at any time.
The Game sends analytics, performance figures and crash reports only if you agree when it asks, and it asks that separately from this Agreement. Accepting this Agreement is not agreement to send them. The Privacy Policy explains what the Game handles, and What the Game Sends lists it field by field.
This Agreement lasts until it is ended. You can end it at any time by ceasing to play the Game and uninstalling the desktop app. Your licence ends automatically if you break this Agreement, and we may also suspend your access to online features under the Terms of Service. When the licence ends, you must stop using the Game. Sections 3, 5, 9, 10 and 11 continue to apply.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS, OR THAT SAVED GAMES AND PROGRESS WILL NEVER BE LOST.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU HAVE PAID US FOR THE GAME IN THE 12 MONTHS BEFORE THE CLAIM (WHICH, FOR A FREE GAME, IS ZERO).
Nothing in this Agreement limits or excludes liability that cannot be limited or excluded by law, or affects the rights you have as a consumer under the law where you live.
This Agreement is governed by the same law, and disputes are resolved in the same way, as set out in the "Governing Law and Disputes" section of the Terms of Service. If any part of this Agreement is found to be unenforceable, the rest remains in force.
We may update this Agreement, and the date at the top shows when it last changed. If a change affects what you may do with the Game or what you owe us, the Game will ask you to accept the new version before you play again.
